Protecting the “Little Guy”

Case Background

The Company was a soy bean based coffee roaster and distributor founded by the Plaintiff. After founding the Company, the Plaintiff invited his doctor and friend, to join the Company as his partner. Subsequent to learning Company’s secrets and business plans, the doctor and his best friend, a salesman, misappropriated the Company’s identity, strategy, and products and seamlessly transferred them to their own entity called New Co. In the process of growing New Co. into a multi-million dollar business, the doctor and the salesman discarded Plaintiff entirely from the Business. Plaintiff charged the Doctor and Salesman with Breach of Contract, Breach of Fiduciary Duty, and Fraudulent Concealment, amongst other wrongdoings, and sought damages for economic losses as a result of the acts of Doctor and Salesman.
